At Jivi, we are committed to maintaining the confidentiality and security of any personal information about our users. Your privacy is always at the top of our priorities. In order to ensure transparency and give you more control over your personal information, this privacy policy (“Privacy Policy”) governs how we (“Jivi”, “we”, “our” or “us”) use, collect and store personal information we collect or receive from or about you (“you”) such as in the following use cases:

  • When you sign up to receive our latest updates on the Website and to receive our blog insights;

  • When you use our free trial product or request us to provide you a demo;

  • When you sign up for, log in to and use our platform or bot (“Service”) on devices, APIs, and third parties;

  • When you purchase a subscription to the Service;

  • When you contact us (e.g. support, need help, or on social media);

  • When you attend a marketing event, provide us with your business cards and/or provide us with your personal data for marketing purposes;

  • When we acquire your personal data from third-party sources (such as lead-generation companies);

  • When we use the personal data of our service providers (e.g. contact details); and

Information you provide voluntarily

 

Certain parts of our Website or Jivi Service ask you to provide certain information voluntarily. This typically includes:

1. Identification information, such as your name, company and job title

2. Contact information, such as your phone number, email address, and home and/or business postal addresses.

3. Log-in credentials, such as your username and password to access the Jivi Services.

4. Demographic Data. In some cases, such as when you register or participate in surveys, we request that you provide age, gender, and similar demographic details.

5. Payment Information, such as your bank account number; credit card number and associated identifiers and billing address but only when you pay for the Jivi Services.

6. Support data, such as feedback or information about a technical issue you have reported.

7. Marketing information such as your marketing preferences.

8. Communication data, such as any information you include in any enquiry or communications you send us.

9. Call Data: With your consent, we collect and analyze data from sales calls, including transcriptions, to provide personalized insights. This includes audio recordings, conversation cues, and any other data provided during the use of our live call analysis feature.

10. Any other information you provide / upload to the Service.

11. Any information you choose to provide to us when completing any ‘free text’ boxes in our forms or blogs.

 

Information we collect automatically

 

Like most companies that offer online services, we may automatically collect certain information from your computer or device, about your use of the Jivi Service or our Website. We use this information to provide our Services, ensure the security of our Services, help improve our Services and promote our Services to you. This typically includes:

Cookies data: We collect certain information through cookies and other tracking technologies such as your computer or device’s Internet Protocol ("IP") address, browser type, the web page visited before or after you came to our Website, information you search for on our Website, locale preferences and identification numbers associated with your devices.

Location data: We may derive your general location based on your IP address.

The Website uses a tool called “Google Analytics” to collect information about use of the Website. Information we obtain from third-party sources

 

From time to time, we may receive personal information about you from third party sources but only when these third parties have confirmed to us that they either have your consent or are otherwise legally permitted or required to disclose this information to us. This typically includes:

 

‍Data Supplementation. We may receive additional demographic information (including your company, job title or business contact details) about you from other sources, including publicly available databases or third parties such as lead generation providers or business intelligence platforms from whom we have purchased data. We combine this data with information we already have about you. This helps us to maintain and improve the accuracy and relevance of our records, identify new opportunities, and send you information about products and services that may be of interest to you in accordance with your marketing preferences.

‍Sign-in information: If you log in to our Services using a third party sign-in service (such as LinkedIn), we will collect information from that sign-in service that you give us permission to receive. This may include information such as your name, social media profile and location. We only collect this information to provide the Services to you. Please refer to the privacy settings of the third party sign-in service you use to manage the information that is shared.

 

How We Use Personal Information

 

We use personal information about you for the purposes detailed below. In some regions, such as the European Economic Area, the United Kingdom and Switzerland, we need a lawful basis to collect, use and disclose your personal information. ‍Sending promotional and marketing information to you in accordance with your marketing preferences: If you are the administrator of a Client account, we may send you marketing communications about Jivi and other services provided by us. We will do this in accordance with your marketing preferences and on the basis of our legitimate interests in building our customer base and promoting our services offered by us, or, where required, with your consent.

 

‍Sending technical notices, updates, security alerts, and other support and administrative messages to our Jivi Users: If you are an Jivi User, We may use your personal information to send you administrative messages in reliance on our legitimate interests in administering the Jivi Service, including for security and operational issues that affect multiple Clients or Jivi Users.

 

‍Providing technical and customer support to Jivi Users: If you are an Jivi User, We use personal information to troubleshoot and diagnose problems, and provide other customer care and support services, including to help us provide, improve, and secure the quality of our products, services, and training, and to investigate security incidents in reliance on our legitimate interests.

 

‍Responding to questions, requests and feedback from those that interact with us: If you fill out a web form or request support, if you contact us by other means, including via a phone call, we use your personal information in reliance on our legitimate interests in fulfilling your requests and communicating with you.

 

Managing events: We use personal information to plan and host events or webinars for which you have registered or that you attend, including sending related communications to you, in reliance on our legitimate interests in administering and promoting the event, or where required, with your consent.

 

‍Detecting, preventing and responding to potential fraud, violations of our terms and conditions or other misuse of our Services: We process personal information by tracking use of our Services for the purposes of maintaining their security, including verifying accounts and activity, investigating suspicious activity, and enforcing our terms and policies, in reliance on our legitimate interest in promoting the safety and security of the Services, systems and applications and in protecting our rights and the rights of others.

How we protect and retain your information

 

Security. We have implemented appropriate technical, organizational and security measures designed to protect your personal information. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

 

Retention of your personal information. Your information will be stored until we delete our records, and we proactively delete it, or if you send a valid deletion request. Please note that in some circumstances we may store your personal information for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, and/or (iii) if we reasonably believe there is a prospect of litigation relating to your personal information or dealings. We have an internal data retention policy to ensure that we do not retain your personal information perpetually.

  • If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we may disclose your personal information to such third party (whether actual or potential) in connection with the foregoing events;

  • In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we may transfer, disclose or assign your personal information in connection with the foregoing events; and/or

  • Where you have otherwise provided your consent to us for sharing or transferring your information.

 

International Data Transfers: Jivi operates in multiple countries and our service providers are located in the US and other countries. This means that we may transfer, store, and process your information in countries other than your own. By using our Service, you consent to the transfer of information to countries outside your country of residence, which may have different data protection rules than in your country. However, we take appropriate safeguards to ensure that your information remains protected in accordance with this Privacy Statement and applicable data protection laws.

 

Data Protection Rights

 

Rights: You can exercise your rights by contacting us at support@getjivi.com. subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

 

Account information. If you are a Client Representative and are registered with us, you may review, update, correct, or delete certain personal information provided in your registration or account profile by changing your account settings.

 

Deleting your account: Should you ever decide to delete your account, you may do so by emailing support@getjivi.com If you terminate your account, any association between your account and personal information we store will no longer be accessible through your account.

 

Marketing emails – opt-out: You may choose not to receive marketing email of this type by sending a single email with the subject “UNSUBSCRIBE” to support@getjivi.com. Please note that the email must come from the email account you wish to block OR if you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt.

 

Use By Children

 

We do not offer our products or services for use by children and, therefore, we do not knowingly collect personal information from, and/or about children under the age of 18. If you are under the age of 18, do not provide any personal information to us without involvement of a parent or a guardian. In the event that we become aware that you provide personal information in violation of applicable privacy laws, we reserve the right to delete it. Interaction With Third Party Products

 

We enable you to interact with third party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal information from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service.

 

Log Files

 

We use log files. The information inside the log files includes internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us. We use such information to analyze trends, administer the Website, track users’ movement around the Website, and gather demographic information.

 

Specific Provisions Applicable Under California Privacy Law

 

If you are a California resident, you may have the following consumer privacy rights:

 

Our California Do Not Track Notice: Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

 

Right to Know - You have a right to request that we disclose to you the personal information we have collected about you. Further, to provide or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law.

 

Right to Request Deletion - You also have a right to request that we delete personal information under certain circumstances, subject to a number of exceptions. To make a request, please complete a request to support@getjivi.com

 

Right to Non-Discrimination - We will not discriminate against you for exercising any of these rights.

 

If you are a California resident under the age of 18 and a registered user, California Business and Professions Code Section 22581 permits you to remove content or personal information you have publicly posted.  If you wish to remove such content or personal information and you specify which content or personal information you wish to be removed, we will do so in accordance with applicable law.  Please be aware that after removal you may not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or personal information you have posted and that there may be circumstances in which the law does not require us to enable removal of content.

 

Your Choices

 

You have certain choices about your Personal Information. Where you have consented to the processing of your personal information, you may withdraw that consent at any time and prevent further processing by contacting us as described in this Privacy Policy. Even if you opt out, we may still collect and use non-personal information regarding your activities on our services and for other legal purposes as described above. While we cannot guarantee privacy perfection, we will address any issue to the best of our ability as soon as possible. Data Retention

 

Jivi will retain personal data we process about Jivi Users for as long as we have a legitimate business purpose to do so. If you wish to cancel your account or request that we no longer use your information to provide you Services, you may delete your account. Please note that Jivi may retain your personal data for longer where there is a legal, tax or accounting obligation, contractual, or legitimate interest, including resolving disputes and enforcing our agreements and rights. When we no longer have an ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your information has been stored in backup archives), then we will securely store your information and isolate it from any further processing until deletion is possible.

 

Please note that Jivi will retain Client Data that we process on behalf of our Clients for as long as needed to provide services to our Clients and in accordance with our agreements with our Clients.

 

Security

 

Jivi stresses its privacy and security standards. Although no one can guarantee absolute security, we regularly re-evaluate our privacy and security policies in order to adapt to new challenges. We follow generally accepted standards to protect the information submitted to us, both during transmission and once we receive it.

 

Changes to our Privacy Statement

 

We may update this Privacy Statement from time to time. If we make a material change to this Privacy Statement, we will provide you with notice (for example, by email, a sign-in notification, or some other means) and obtain your consent if and where this is required by applicable data protection law prior to the change becoming effective.
